The decision ensures that Red Bull must face allegations of liability for injuries Crawley sustained during a “media flight” at the 2017 Flugtag event at the Pittsburgh Three Rivers Regatta.

The case, spearheaded by attorney Ernest J. Pribanic of Pribanic & Pribanic LLC, centers on claims that Crawley was not adequately warned about the risks of participating in the event.

During the preview, Crawley was tasked by his employer at Red Bull’s request to ride a flying contraption off a pier into the Allegheny River, resulting in a belly flop that caused injuries to his head and spleen.

According to Law 360, Judge Arnold Klein’s ruling rejected Red Bull’s argument that Crawley had knowingly assumed the risks by signing a document entitled Professional Media Permit and Release Agreement. Red Bull alleged that the document was actually a waiver of liability, but the court did not accept Red Bull’s contention.

“Judge Klein’s ruling paves the way for accountability,” said Ernest Pribanic, lead counsel for Crawley. “By rejecting the defendants’ second attempt to dismiss this case, the court has ensured that they must answer for their actions.

The case highlights allegations that Red Bull and event organizers failed to provide adequate safety measures and actively concealed the risks associated with the event.

Crawley’s legal team has presented evidence of other injuries sustained during similar Flugtag events, including depositions from other participants and claims that Red Bull deleted online records of such incidents.

The trial is scheduled to begin in September 2026.

The case is Crawley et al. v. Red Bull et al., case number GD-19-009994, in the Court of Common Pleas for Allegheny County, Pennsylvania.
